When the FBI’s sting operation “Crossfire Hurricane” targeted a low-level Trump campaign operative before the 2016 election far more was at stake than who would be the next President. Two years later we are learning that the very soul of our Republic, the Constitution, was under attack.
Before the Barack Obama began his second term in 2012, Paul Roderick Gregory of Forbes Magazine wrote: “Obama views the Constitution as a flawed document from which we must ‘break free.”
Now that Obama is out of office, it is becoming clear that his views were not hyperbole. His State Department, Justice Department, and entire intelligence apparatus operated under the assumption that the time had come to throw off the shackles of the Constitution.
The New York Time broke the story of Crossfire Hurricane, a secret group of FBI agents codenamed surveilled President Trump and his campaign months before the 2016 presidential election. What the Times conveniently ignored is that a shadowy clique of agents operated outside of the law on foreign soil for a singular purpose – to deflect attention from Hillary Clinton and her email scandal toward Donald Trump.
The fact that the FBI under James Comey pursed Clinton in a criminal case that involved a mountain of incriminating evidence and initiated a counterintelligence investigation of Donald Trump is cause enough to realize the rule of law is in serious jeopardy. There is nothing in established criminal law that justified an investigation of any Trump-campaign official and plenty in the case of Hillary Clinton.
Even though there was more than enough to indict Clinton, Comey declared she did not break the law but was rather “reckless.” Trump, on the other hand, was not the subject any criminal charges. Instead, the bureau initiated a counterintelligence investigation in the hopes that evidence of crimes committed by Trump officials would be discovered. Why the difference? Criminal cases involve grand juries, and judges, and full disclosure. Counterintelligence investigation is shrouded in secrecy. One demands a crime already exists, the other hopes to find one it can then turn over to the criminal courts to prosecute.
The FBI’s fishing expedition was a clear abuse of power that its spying and electronic surveillance, to conduct what was really a criminal investigation.
“You can bet [Obama] was briefed on this operation against the campaign, especially given its sensitive nature,” said Tom Fitton of Judicial Watch.
What happened next was an act of calculated risk. If Clinton won the election, everything would go away or at least be swept under the rug and forgotten. But as Joe diGenova said after Trump won, “They knew since Hillary didn’t win, now it was going to come out and they needed a story.”
Trump not only surprise pollsters and the mainstream media but his win caught Obama and Susan Rice off-guard. They knew they had been trashing the Constitution through their abuse of the FBI and something must be done.
Andrew McCarthy, a former terror prosecutor, explains:
Counterintelligence is done for the president,” McCarthy explained. “The purpose of it is…to enable the president to…(protect) the country from foreign threats to national security. But what if Obama abused that constitutional authority in order to carry out his own top priority: Keeping Democrats in power?”
It doesn’t appear that is a “what if” anymore. At the height of a presidential race, the FBI collaborated with the CIA to probe an American political campaign. In an effort to fashion a criminal case they used informants and foreign-intelligence surveillance with the blessing of the Obama White House.
Federal law says an American unlawfully acts as an agent of a foreign power if they are purposefully engaging in clandestine activities on behalf of a foreign power. It is probable that these activities violate federal criminal law. (FISA, Title 50, U.S. Code, Section 1801(b)(2).
President Obama, the head of the FBI and CIA co-opted the powers that enable our government to spy on foreign adversaries and used them to spy on Americans — Americans who were their political adversaries.
Michael Barone observed: “[This] dangerous departure from (constitutional) norms may be that of the Obama officials seeking to overturn the results of the 2016 election.”
Our Founding Fathers would not be surprised to learn that our spying apparatus designed to protect Americans has now become a political tool that targets Americans for partisan purposes.
