Fake News Touts DACA Win As Judge Rules It Illegal

A federal judge recently ruled the DACA program established by the Obama Administration is illegal but the fake news media says the left won.

The idea of claiming victory against Pres. Donald J. Trump has been short-sighted and often false since the first high-profile litigations. Everyday Americans may remember resist and obstruct Democrats enlisting the help of liberal judges to stymie the president’s Travel Ban. After shopping for like-minded judges, the left was able to keep America less safe until the U.S. Supreme Court overturned each and every misguided ruling.

In many respects, the recent ruling about the Deferred Action for Childhood Arrivals (DACA) mimics the “we won” coverage by biased media outlets. Although a federal judge allowed the DACA program to stand, temporarily, he was clear and to the point the program is as illegal as those who cross the southern border in the dead of night.

Fake News Media Misleads about DACA Ruling

In a massive 117-page decision, the U.S. District Court for the Southern District of Texas ruled that the program violates specific tenets of law.

Led by Texas Attorney General Ken Paxton, eight states challenged the legality of the Obama-era DACA program. Many legal experts believe the executive action violates the U.S. Constitution, saying the ex-president overstepped his authority by creating law.

When confronted by a Republican-led charge to end the program, Pres. Trump built a compromise that gave Congress time to create a legal legislative fix. Democrats voted against giving the so-called “Dreamers” pathway to citizenship.

Following the Democrats’ anti-Dreamer votes, the president began to phase out the program. His decision still provided Congress additional time to pass legislation and do the right thing by these young people. But the chickens have come home to roost, so to speak. In the wake of Democrats betrayal of the Dreamers they claimed to support, the left oddly judge-shopped to keep the illegal Obama program in place indefinitely.

Much like the travel ban farce, left-leaning judges cared more about the Obama legacy than being faithful to the Constitution. The recent lawsuit by Republican attorney generals will likely end the DACA program unless Democrats join Republicans to stop the deportation of these young people.

Still, the left-leaning media persists in false headlines and opinions. Here’s some examples:

The internet is littered with this fake news narrative. It’s difficult to understand whether the biased media has become incapable of telling the truth or suffers Trump Derangement Syndrome.

Either way, fake news outlets such as these are creating false hope for children that were brought to the United States illegally and at no fault of their own. The lying media also provides Democrats with a political campaign chip that the party has prevailed in the courts.

Truth about DACA Ruling

In the lawsuit led by Texas’ Paxton, Judge Andrew Hanen denied immediate relief to DACA nationwide based on technical grounds. But the fake news media omits the fact that the federal judge did agree that the plaintiffs are likely to succeed in ending DACA.

Judge Hanen reportedly “agreed that the attorneys general, led by Paxton, were correct in their interpretation of the law — that the Obama administration’s controversial 2012 executive action violates the Administrative Procedure Act (APA) and impermissibly orders the federal government to ignore American immigration laws,” according to Breitbart.

In his lengthy decision, the judge pointed out that Obama likely violated the foundational principles of the U.S. Constitution as well as federal law when implementing the program.

“This court, guided by Fifth Circuit precedent, holds that none of the claimed statutory provisions give the DHS the authority to implement DACA. While the provisions certainly grant some authority to the agency they do not extend to include the power to Institute a program that gives lawful presence, work authorization, and multiple other benefits the 1.5 million people,” Judge Hanen reportedly wrote in his decision.

Judge Hanen gave a backhanded rebuke to the liberal judges who demonstrated political bias in other decisions.

“This court will not succumb to the temptation to set aside legal principles and to substitute its judgment in lieu of legislative action,” Judge Hanen reportedly wrote. “If the nation truly wants to have a DACA program, it is up to Congress to say so.”

Contrary to the fake news headlines, Texas A.G. Paxton rightfully claimed victory.

“We’re now very confident that DACA will soon meet the same fate as the Obama-era Deferred Action for Parents of Americans program, which the courts blocked after I led another state coalition challenging its constitutionality,” Paxton reportedly said.

“President Obama used DACA to rewrite federal law without congressional approval. Our lawsuit is vital to restoring the rule of law to our nation’s immigration system. The debate over DACA as policy is a question for lawmakers, and any solution must come from Congress, as the Constitution requires.”

While the program remains intact on a temporary basis due to technical hurdles faced by the plaintiffs, it is now on an appeal fast-track. Americans can expect more resist and obstruct liberal judges to rule in favor of Obama’s illegal program.

However, DACA will likely meet its end at the U.S. Supreme Court.
