Lindsey Graham Vows to Get to the Bottom of the Department of Justice’s Attempted Coup Against President Trump

The Constitution makes it incredibly difficult to remove a sitting President from office, and rightfully so; only in the most extreme of circumstances should a leader that was elected by the people be removed by anyone other than the American people and by any means other than another election.

There are two recourses that allow for the removal of a President before their term has ended. The first is impeachment – a measure Democrats have been pushing for ever since Donald Trump took office in spite of the fact that there is no real evidence that he has committed any crimes.

However, the Constitution also allows for a second course of action by which a sitting President may be removed from office. According to the 25th Amendment, a President may be removed from office if a majority of his cabinet along with the Vice President votes that the President is mentally unfit to hold the position.

Of course, there’s zero evidence that Trump is mentally unfit for office as well, but that didn’t stop the Department of Justice from exploring behind closed doors the possibility of invoking the 25th Amendment in order to oust President Trump.

According to former FBI Deputy Director Andrew McCabe, Deputy AG Rod Rosenstein held private meetings in which he and other high-level members of the DOJ discussed the possibility of convincing Vice President Mike Pence and a majority of the President’s cabinet to vote for Trump’s removal.

McCabe claims that Rosenstein even offered to wear a wire into the White House in order to try to catch Trump saying something that might prove he was unfit for office. Rosenstein has since tried to say that he was only joking when he made this remark, but McCabe maintains that the deputy AG was completely and obviously serious.

While removing a President via the 25th Amendment is certainly a legal and even could be found justifiable in other scenarios, the Constitution is very specific about when the 25th Amendment applies. A President cannot legally be removed just because a majority of his cabinet and the Vice President votes for his removal. Per the language of the 25th Amendment, any cabinet member that casts their vote for the removal of a President must submit to Congress a written declaration that they have found that the President is “unable to discharge the powers and duties of his office”.

This last line has been interpreted to mean that a President must be suffering from either a physical or mental condition that prevents them from fulfilling their duties before they can be removed via the 25th Amendment. Since there is no evidence that President Trump in any way fits this description, any attempt to remove him from office -through the 25th Amendment or otherwise – would constitute nothing more than a highly illegal coup.

Now that news about what Rod Rosenstein and the DOJ attempted to do has broken, Sen. Lindsey Graham has vowed that Congress will investigate the allegations against him. Appearing on “Face the Nation”, Sen, Graham said, “The whole point of Congress existing is to provide oversight of the executive branch. So through good reporting by ’60 Minutes,’ there’s an allegation by the former acting FBI director that at the time the deputy attorney general was basically trying to do an administrative coup, take the president down by the 25th Amendment process. The deputy attorney general denies it. So I promise your viewers the following; that we will have a hearing about who’s telling the truth, what actually happened. Mr. McCabe, you remember, was dismissed from the FBI for leaking information to the press. So you’ve got to remember the source here.”

Assuming that McCabe’s allegations are true, though, the reputation of both the DOJ and the FBI will suffer even more than it already has. Of course, these kind of controversies were almost inevitable the moment Trump took office. When you make it your mission to drain the swamp, it’s only natural that the swamp is going to fight back.

However, if there’s one thing that Trump has certainly accomplished in his efforts to rid Washington of corruption, it’s forcing those who are guilty out into the spotlight. Now that Rod Rosenstein’s actions have been brought out into the limelight, it’s time for him to face the music.
